Terms of Service

Clearwell provides an online service that analyzes medical bills and insurance Explanation of Benefits (EOB) statements. You upload documents, and we use automated tools to extract information, compare your documents, and generate plain-English explanations, recommendations, and related materials.

The service is provided for informational purposes only and is not a substitute for professional medical, legal, or financial advice.

• You must be at least 18 years old to use the service.
• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
• You must promptly notify us of any unauthorized use of your account.

You retain ownership of the documents you upload. By uploading documents, you grant us a limited license to process, store, and use them solely to provide and improve the service. You represent that you have the right to upload the documents and that doing so does not violate any agreement or law.

You agree not to use the service to:

• Upload documents you are not authorized to access or share;
• Violate any applicable law or regulation;
• Attempt to interfere with, disrupt, or gain unauthorized access to the service or its systems;
• Reverse engineer, decompile, or copy the service or its components;
• Use the service to generate findings, scripts, or letters for fraudulent purposes.

The service is offered as a one-time payment with no subscription. You authorize us (or our payment processor) to charge the applicable fee when you purchase an analysis.

No refunds are offered. All purchases are final. Once a payment is made, the fee is non-refundable for any reason, including dissatisfaction with the analysis or changes to the service, except where a refund is required by applicable law.

We may change pricing or features at any time. Changes to pricing for a purchase apply only to purchases made after the change takes effect.

The service, including its software, design, content, and branding, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the service for your personal, non-commercial purposes in accordance with these Terms.

Clearwell is not a medical provider, law firm, or financial advisor. The service provides automated, informational analysis and does not constitute medical, legal, or financial advice. Results reflect potential discrepancies and are not guarantees of savings or claim outcomes. You are solely responsible for decisions you make based on the service.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that results will be accurate or complete. Your use of the service is at your own risk.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim arising out of or related to the service will not exceed the amount you paid for the specific analysis that gave rise to the claim.

You agree to indemnify and hold us and our officers, employees, and agents harmless from any claims, damages, losses, or expenses arising out of your use of the service, your uploaded content, or your violation of these Terms.

We may suspend or terminate your access to the service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or to protect the security and integrity of the service. You may stop using the service and delete your account at any time. Termination does not relieve you of obligations that by their nature survive termination, including payment obligations.

We may update these Terms from time to time. We will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws applicable to Clearwell's place of establishment, without regard to conflict-of-law principles, and any disputes will be resolved in the courts of that jurisdiction. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
